These Messaging Terms & Conditions (“Messaging Terms”) govern the SMS and email messaging programs operated by Reply Amp (“Reply Amp,” “we,” “us,” or “our”). By enrolling in or otherwise using any Reply Amp messaging program, you agree to these Messaging Terms, our Privacy Policy, and our Website Terms of Service. If you do not agree, do not enroll or use our messaging programs.
These Messaging Terms are drafted to align with CTIA Messaging Principles and Best Practices and A2P 10DLC carrier vetting requirements, including clear opt-in consent, opt-out mechanisms, message frequency disclosures, and the “message and data rates may apply” disclaimer. 1. Program Description
Program name: Reply Amp Alerts and Updates
Message types: Account notifications, product updates, service alerts, onboarding messages, transactional notices, and optional marketing/promotional content if you separately consent to receive marketing.
Delivery channels: SMS/MMS to your mobile number and/or email to your provided email address.
Message frequency: Message frequency varies based on your interactions and preferences; for transactional alerts it may be event-driven. For marketing programs, frequency varies and will be disclosed at the point of opt-in.
Cost disclosure: Message and data rates may apply.

2. How You Opt In
You may opt in through one or more of the following methods:
Website or form: By submitting your mobile number and/or email and affirmatively selecting a consent checkbox that clearly discloses the program, message types, frequency, and applicable rates.
In-product or account sign-up: By providing your contact details during onboarding and affirmatively consenting to receive messages.
Text-to-join: Where available, by texting a program keyword to our designated long code or toll-free number after seeing a compliant call-to-action.
Verbal or paper consent: If collected offline, we will retain records of the disclosures and your consent.
Your consent must be clear and conspicuous. For promotional messages, we require express written consent (e.g., checking a box). Guidance: 10DLC.org on required consent types and Ubiquiti A2P requirements.
Example website consent language: “By providing your phone number and/or email, you agree to receive messages from Reply Amp about your account and services. Message frequency varies. Message and data rates may apply. Reply OUT to opt out. Reply HELP for help. See our Privacy Policy and these Messaging Terms.”
3. Opt-Out Instructions (Keyword “OUT”)
You can cancel SMS at any time by replying with the keyword OUT. After you send OUT, we will send a confirmation message and you will no longer receive SMS messages from that specific program. If you have multiple programs or channels, you may need to opt out of each separately. For email, click the unsubscribe link in any email or reply “OUT” to an email if indicated.
Standard keywords that we also honor: STOP, CANCEL, END, QUIT, UNSUBSCRIBE. While your preferred opt-out keyword is “OUT,” we will honor carrier-standard keywords as recommended by CTIA/carriers for A2P messaging compliance. To rejoin, follow the original opt-in flow or text START/UNSTOP/YES where supported.

5. Eligibility and Responsibility
You must be the account holder or authorized user of the phone number or email account you enroll, and you must be 18 or older or have the consent of a parent/guardian.
You are responsible for notifying us if you change or deactivate your mobile number or email address. We are not responsible for messages sent to numbers or addresses you no longer control.
6. Carrier and Delivery Disclaimers
Carriers are not liable for delayed or undelivered messages.
Delivery of SMS/MMS is subject to your mobile carrier’s network and your device capabilities.
Messaging is available in the U.S. only unless otherwise stated. International availability may vary.
These statements align with standard carrier-required disclaimers (see examples in Ubiquiti’s boilerplate TOS).
7. Charges and Frequency
We do not charge you for SMS messages, but your carrier’s message and data rates may apply.
Message frequency varies by program and may be event-driven (e.g., account alerts). If a frequency is specified at opt-in, that frequency is a maximum estimate and may vary due to system conditions and your usage.

8. Privacy
We respect your privacy. As stated in our Privacy Policy:
No mobile information will be shared with third parties or affiliates for marketing/promotional purposes.
All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties except for vendors and service providers who assist in delivery of the messaging services and only for that purpose.
This language aligns with common 10DLC privacy requirements that prohibit sharing opt-in data for marketing purposes, as reflected in compliance guides such as Ubiquiti and third-party summaries (Dental Intelligence FAQs).

9. Content Restrictions
You may not use our messaging programs to send or solicit any prohibited content, including but not limited to content related to SHAFT categories (sex, hate, alcohol, firearms, tobacco/cannabis where prohibited), illegal goods/services, or any content violating applicable law, carrier policies, or our Terms of Service.

10. Consent Records and Verification
We maintain records of your consent, the disclosures presented at opt-in, and your opt-out status. If your opt-in occurred behind a login or offline, we maintain sufficient documentation for verification consistent with manual vetting expectations.

We may update these Messaging Terms from time to time. If we make material changes, we will notify you by updating the “Last updated” date and may provide additional notice where required by law.
